GDPR privacy policy for the processing of personal data and cookies

This privacy policy contains information on the handling of your data. The data is collected, used and processed in accordance with the provisions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC of 27 April 2016 (GDPR).

  1. Purpose, collection, use and processing of personal data

Personal data is processed in order to provide GlobalBid Services as defined in the Terms of Service, i.e. browsing and listing items for sale, as well as auctioning Items*. The legal basis for personal data processing is Article 6(1)(b) of the GDPR is the Account is created by a private person or a sole proprietorship. If the Account is created to represent an organization (e.g. a limited liability company), the legal basis is Article 6(1)(f) of the GDPR.

Moreover, personal data is processed for the purpose of:

– admission to auctions pursuant to Article 6(1)(b) of the GDPR;

– enabling the use of item review and sale services via the GlobalBid website  – pursuant to Article 6(1)(b) of the GDPR;

– consideration of claims related to warranty and guarantee – Article 6(1)(b-c) of the RODO;

– identifying and pursuing claims by the Administrator in relation to the user’s failure to observe their obligations under the contract, or defend against claims towards the Administrator before enforcement authorities, adjudicating authorities, as well as in administrative proceedings – Article 6(1)(f) of the GDPR

– ensuring the security of an auction ran by the Administrator  – Article 6(1)(f) of the GDPR,

– receiving information on auctions and events held by the Administrator – Article 6(1)(a) of the GDPR,

– statistics – data analysis and profiling for the purpose of marketing the Administrator’s products and services – based on Article 6(1)(f) of the GDPR,

– enabling GlobalBid to fulfil its obligations under relevant applicable fiscal and accounting regulations – the legal basis for data processed for that purpose shall be Article 6(1)(c) of the GDPR as well as the Polish fiscal law,

– defending against and pursuing claims – the legal basis for such data processing shall be Article 6(1)(f),

–  service quality enhancement, analysing GlobalBid service use by users, and ensuring the security of the data within the GlobalBid service, including mainly but not limited to data related to security and contained in cookies. The legal basis for such data processing shall be Article 6(1)(f),

The personal data categories include, among others, name (first and last name), residence/company seat, domestic tax ID (NIP), European tax ID (EU-NIP), e-mail address. Users have the right to decline to share their personal data, however, failure to submit the required data will render GlobalBid services inaccessible;

III. Recipients of data

Your personal data may be transferred to/shared with entities the Administrator subcontracted for the purpose of personal data processing, i.e.: suppliers, service providers and partners which GlobalBid enters cooperation with to the extent necessary to provide services to customers, maintain business contacts, perform marketing activities, and handle its own activity, among others, in case of preparing ads for customers as defined in the Terms of Service, external entities, such as: Grupa Dekra Polska Sp. z o.o. with its registered office at Ulica Konstruktorska 12A, 02-673 Warsaw, DEKRA Certification Sp. z o.o. with its registered office at Ulica Legnicka 48H, 54-202 Wroclaw.

Your data shall not be transferred to a third country or international organisations.

  1. Period of data processing

Depending on the purpose of personal data processing, your personal data will be stored for the duration of the legitimate interest of Administrator, the period of performance of obligations, the moment of limitation of claims resulting from the relevant regulations, the date of sustaining the submitted objection or the date of consent withdrawal.

Notwithstanding the above, your data will be processed for as long as required by the provisions of tax and accounting law.

  1. Rights related to personal data processing

You have the right to access your data and the right to rectify, delete, limit processing, the right to transfer data, the right to object (when the basis for processing is the legitimate interest of Administrator), the right to withdraw consent (when the basis for processing is consent) at any time without affecting the lawfulness of processing which was made on the basis of consent before its withdrawal.

The exercise of these rights depends on the conditions set out in the GDPR. If your request is denied, you will receive a response with a justification for the refusal.

You have the right to lodge a complaint with the supervisory body dealing with personal data protection which is the President of the Office for Personal Data Protection, if you consider the processing of your personal data to be in violation of the provisions of the Act of 10 May 2018 on the protection of personal data (consolidated text Journal of Laws of 2018, item 1000) or the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to processing  personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016 (OJ L No 119, p. 1);

GlobalBid employs several technological and organisational measures aimed at ensuring the security of your personal data and digital resources.

For that purpose, GlobalBid may obtain data which internet browsers transfer to the server.

Data recorded in this manner include: date and time of the visit and the IP address. This information is used in diagnosing problems related to server operation, analysing possible security breaches and in managing the website. In addition, we use the IP address for statistical purposes, i.e. to collect and analyse demographic data of website visitors (e.g. information about the region from which the connection was made). On the basis of the information obtained in the above manner, in special cases, aggregated, general statistical summaries are prepared, disclosed to third parties cooperating with us. These usually include information about the viewership of the service. However, GlobalBid would like to emphasize that these lists do not contain any data allowing for the identification (determination of identity) of a given user of the services.

  • Cookies policy

In order to facilitate the use of our website, we use cookies. These are small text files that are stored on your computer or other mobile device when you use websites.

 Cookies usually contain the domain name of the website from which they originate, the time of their storage on the end device and a unique number. Cookies may be placed on the end device of the website visitor and then used by external providers cooperating with GlobalBid to monitor traffic and activity on the website.

Cookies allow, among others, to use the various functions provided for on a given website or to confirm that a given user has seen certain content from a given website. It is possible to distinguish cookies that are necessary for the operation of GlobalBid websites. Such cookies are used to provide:

  • maintaining the user’s session;
  • saving the current status of the user’s session;
  • saving information allowing the user to log in anonymously;
  • monitoring service availability.

Another category of cookies are files that are not necessary to use the services, but facilitate their use. They are used to enable:

  • automatic logins to the product (the “remember me” feature);
  • creating viewing statistics of particular content,
  • checking whether accepting cookies functions properly;
  • customizing the services provided via the website,
  • providing users with personalized advertising content,
  • authentication of website users,
  • setting the preferred language, font size and other such properties to facilitate service use;
  • restoring the last search result on the site,
  • displaying the last selected sort parameter,
  • restore the last view visited the next time you log in to the product.

Cookies are not used to process or store personal data, they cannot be used to directly identify the website visitor and do not introduce configuration changes in the browser and telecommunications end device. The user has the opportunity to independently determine the conditions for the use of cookies and at any time can disable their operation, using the settings of the web browser or configuration of the service. This can cause most websites to be inaccessible or not displayed properly.

Failure to change the settings for cookies means that they will be placed on the user’s end device, and thus GlobalBid will store information on the user’s end device and access it.
